Data Collection on Our Website

Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. You can find their contact details in the imprint of this website.

How do we collect your data?

Your data is collected, on the one hand, by you providing it to us. This may include, for example, data you enter into a contact form.

Other data is automatically collected by our IT systems when you visit the website. This is primarily technical data (e.g., internet browser, operating system, or time of page view). This data is collected automatically as soon as you enter our website.

What do we use your data for?

Part of the data is collected to ensure the error-free provision of the website. Other data can be used to analyze your user behavior.

What rights do you have regarding your data?

You have the right at any time to receive free information about the origin, recipient, and purpose of your stored personal data. You also have the right to request the correction, blocking, or deletion of this data. For this and further questions on the subject of data protection, you can contact us at any time at the address given in the imprint. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

Furthermore, you have the right to request the restriction of the processing of your personal data under certain circumstances. For details, please refer to the privacy policy under “Right to restriction of processing.”

Analysis Tools and Third-Party Tools

When you visit our website, your surfing behavior can be statistically evaluated. This is primarily done with cookies and so-called analysis programs. The analysis of your surfing behavior is usually anonymous; your surfing behavior cannot be traced back to you. You can object to this analysis or prevent it by not using certain tools. Detailed information on this can be found in the following privacy policy.

You can object to this analysis. We will inform you about the possibilities of objection in this privacy policy.

2. General Information and Mandatory Disclosures

Data Protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.

When you use this website, various personal data are collected. Personal data is data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.

We point out that data transmission over the Internet (e.g., communication by email) can have security vulnerabilities. Complete protection of data from access by third parties is not possible.

Note on the Responsible Party

The responsible party for data processing on this website is:

Roy Hinnen
tridome GmbH
Grepperstrasse 23
6403 Küssnacht

Phone: +41-(0) 41-790 72 88
Email: feedback@triathlon-total.ch

The responsible party is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g., names, email addresses, etc.).

Revocation of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. An informal notification by email to us is sufficient for this. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to Object to Data Collection in Special Cases and to Direct Marketing (Art. 21 GDPR)

If data processing is based on Art. 6 para. 1 lit. e or f GDPR, you have the right at any time, for reasons arising from your particular situation, to object to the processing of your personal data; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your affected personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves the assertion, exercise, or defense of legal claims (objection according to Art. 21 para. 1 GDPR).

If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling, insofar as it is related to such direct marketing. If you object, your personal data will subsequently no longer be used for direct marketing purposes (objection according to Art. 21 para. 2 GDPR).

Right to Lodge a Complaint with the Competent Supervisory Authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work, or the place of the alleged infringement. The right to complain exists without prejudice to other administrative or judicial remedies.

Right to Data Portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to yourself or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done if it is technically feasible.

SSL or TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Information, Blocking, Deletion, and Correction

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient, and the purpose of data processing, and, if applicable, a right to correction, blocking, or deletion of this data. For this and further questions on the subject of personal data, you can contact us at any time at the address given in the imprint.

Right to Restriction of Processing

You have the right to request the restriction of the processing of your personal data. For this, you can contact us at any time at the address given in the imprint. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to assert, exercise, or defend legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Art. 21 para. 1 GDPR, a balancing of your and our interests must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the assertion, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

Objection to Advertising Emails

The use of contact data published within the scope of the imprint obligation for sending unsolicited advertising and information materials is hereby objected to. The operators of the pages expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, for example, through spam emails.

3. Data Collection on Our Website

Cookies

The internet pages sometimes use so-called cookies. Cookies do not cause any damage to your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, effective, and secure. Cookies are small text files that are stored on your computer and saved by your browser.

Most of the cookies we use are so-called “session cookies.” They are automatically deleted after your visit. Other cookies remain stored on your device until you delete them. These cookies enable us to recognize your browser on your next visit.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or generally, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

Cookies that are necessary for carrying out the electronic communication process or for providing certain functions desired by you (e.g., shopping cart function) are stored on the basis of Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. Insofar as other cookies (e.g., cookies for analyzing your surfing behavior) are stored, these are treated separately in this privacy policy.

Server Log Files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

The collection of this data is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this purpose, the server log files must be recorded.

Contact Form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We will not pass on this data without your consent.

The processing of the data entered into the contact form is therefore exclusively based on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time. An informal notification by email to us is sufficient for this. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation.

The data you entered in the contact form will remain with us until you request its deletion, revoke your consent for storage, or the purpose for data storage no longer applies (e.g., after your inquiry has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.

Inquiry by Email, Telephone, or Fax

If you contact us by email, telephone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of handling your request. We will not pass on this data without your consent.

The processing of this data is based on Art. 6 para. 1 lit. b GDPR, insofar as your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on your consent (Art. 6 para. 1 lit. a GDPR) and/or on our legitimate interests (Art. 6 para. 1 lit. f GDPR), as we have a legitimate interest in the effective processing of inquiries addressed to us.

The data you send us via contact inquiries will remain with us until you request its deletion, revoke your consent for storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – in particular statutory retention periods – remain unaffected.

Processing of Data (Customer and Contract Data)

We collect, process, and use personal data only insofar as it is necessary for the establishment, content design, or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 para. 1 lit. b GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures. We collect, process, and use personal data about the use of our internet pages (usage data) only insofar as this is necessary to enable the user to use the service or to bill for it.

The collected customer data will be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.

4. Social Media

Facebook Plugins (Like & Share Button)

Our pages integrate plugins from the social network Facebook, provider Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA. You can recognize the Facebook plugins by the Facebook logo or the “Like Button” on our page. An overview of the Facebook plugins can be found here: https://developers.facebook.com/docs/plugins/?locale=de_DE.

When you visit our pages, a direct connection between your browser and the Facebook server is established via the plugin. Facebook thereby receives the information that you have visited our site with your IP address. If you click the Facebook “Like Button” while logged into your Facebook account, you can link the content of our pages to your Facebook profile. This allows Facebook to associate your visit to our pages with your user account. We point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by Facebook. Further information on this can be found in Facebook’s privacy policy at: https://de-de.facebook.com/privacy/explanation.

If you do not want Facebook to be able to associate your visit to our pages with your Facebook user account, please log out of your Facebook user account.

The use of Facebook plugins is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the widest possible visibility in social media.

If you would like to subscribe to the newsletter offered on the website, we require an email address from you as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. Further data is not collected or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The processing of the data entered into the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke the consent given to store the data, the email address, and its use for sending the newsletter at any time, for example, via the “Unsubscribe” link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you have stored with us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted after unsubscribing. Data stored by us for other purposes
remains unaffected by this.

7. Plugins and Tools

YouTube

Our website uses plugins from the YouTube site operated by Google. The operator of the pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

If you visit one of our pages equipped with a YouTube plugin, a connection to the YouTube servers is established. The YouTube server is informed which of our pages you have visited.

Furthermore, YouTube can store various cookies on your device. With the help of these cookies, YouTube can obtain information about visitors to our website. This information is used, among other things, to collect video statistics, improve user-friendliness, and prevent fraud attempts. The cookies remain on your device until you delete them.

If you are logged into your YouTube account, you enable YouTube to directly associate your surfing behavior with your personal profile. You can prevent this by logging out of your YouTube account.

The use of YouTube is in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

Further information on the handling of user data can be found in YouTube’s privacy policy at: https://policies.google.com/privacy?hl=de.

Google Web Fonts

This site uses so-called Web Fonts, provided by Google, for the uniform display of fonts. When you call up a page, your browser loads the required Web Fonts into its browser cache to display texts and fonts correctly.

For this purpose, the browser you are using must connect to Google’s servers. This gives Google knowledge that our website has been accessed via your IP address. The use of Google Web Fonts is in the interest of a uniform and appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

If your browser does not support Web Fonts, a standard font from your computer will be used.

Further information on Google Web Fonts can be found at
https://developers.google.com/fonts/faq and in Google’s privacy policy:

This page uses the Google Maps map service via an API. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer.

The use of Google Maps is in the interest of an appealing presentation of our online offers and an easy findability of the places indicated by us on the website. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

More information on how user data is handled can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=de.

8. Online Marketing and Partner Programs

Amazon Affiliate Program

The operators of the pages participate in the Amazon EU affiliate program. Amazon advertisements and links to the Amazon.de site are integrated on our pages, through which we can earn money via advertising cost reimbursement. Amazon uses cookies to track the origin of orders. This allows Amazon to recognize that you have clicked the affiliate link on our website.

The storage of “Amazon cookies” is based on Art. 6 lit. f GDPR. The website operator has a legitimate interest in this, as only through cookies can the amount of its affiliate remuneration be determined.

Further information on data use by Amazon can be found in Amazon’s privacy policy:
https://www.amazon.de/gp/help/customer/display.html/ref=footer_privacy?ie=UTF8&nodeId=3312401.

9. Google reCAPTCHA

Google reCAPTCHA Privacy Policy

Our top priority is that our website is protected and secure for you and for us in the best possible way. To ensure this, we use Google reCAPTCHA from Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA). With reCAPTCHA, we can determine whether you are actually a human being and not a robot or other spam software. By spam, we mean any unwanted information that comes to us unsolicited via electronic means. With classic CAPTCHAs, you usually had to solve text or image puzzles for verification. With Google’s reCAPTCHA, we usually don’t have to bother you with such puzzles. In most cases, it is enough to simply check a box to confirm that you are not a bot. With the new Invisible reCAPTCHA version, you don’t even have to check a box. How exactly this works and, above all, what data is used for it, you will learn in the course of this privacy policy.

The legal basis for the use is Article 6 (1) f (lawfulness of processing), as there is a legitimate interest in protecting this website from bots and spam software.

What is reCAPTCHA?

reCAPTCHA is a free Captcha service from Google that protects websites from spam software and misuse by non-human visitors. Most often, this service is used when you fill out forms on the internet. A Captcha service is an automated Turing test designed to ensure that an action on the internet is performed by a human and not by a bot. In the classic Turing test (named after computer scientist Alan Turing), a human determines the distinction between bot and human. With Captchas, the computer or a software program also does this. Classic Captchas work with small tasks that are easy for humans to solve but pose significant difficulties for machines. With reCAPTCHA, you no longer have to actively solve puzzles. The tool uses modern risk techniques to distinguish humans from bots. Here you only have to check the text box “I am not a robot” or, with Invisible reCAPTCHA, even that is no longer necessary. With reCAPTCHA, a JavaScript element is embedded in the source code, and then the tool runs in the background and analyzes your user behavior. From these user actions, the software calculates a so-called Captcha score. Google uses this score to calculate the probability that you are a human even before the Captcha input. reCAPTCHA or Captchas in general are always used when bots could manipulate or misuse certain actions (such as registrations, surveys, etc.).

Why do we use reCAPTCHA on our website?

We only want to welcome real people to our site. Bots or spam software of all kinds are welcome to stay at home. That’s why we pull out all the stops to protect ourselves and offer you the best possible user-friendliness. For this reason, we use Google reCAPTCHA from Google. This way, we can be pretty sure that we remain a “bot-free” website. By using reCAPTCHA, data is transmitted to Google, which Google uses to determine whether you are actually a human. reCAPTCHA thus serves the security of our website and, consequently, your security. For example, without reCAPTCHA, it could happen that a bot registers as many email addresses as possible during registration to then “spam” forums or blogs with unwanted advertising content. With reCAPTCHA, we can avoid such bot attacks.

What data does reCAPTCHA store?

reCAPTCHA collects personal data from users to determine whether actions on our website actually originate from humans. Thus, the IP address and other data that Google needs for the reCAPTCHA service can be sent to Google. IP addresses are almost always shortened within the member states of the EU or other contracting states of the Agreement on the European Economic Area before the data lands on a server in the USA. The IP address is not combined with other Google data unless you are logged into your Google account while using reCAPTCHA. First, the reCAPTCHA algorithm checks whether Google cookies from other Google services (YouTube, Gmail, etc.) are already placed in your browser. Then reCAPTCHA sets an additional cookie in your browser and captures a snapshot of your browser window.

The following list of collected browser and user data does not claim to be exhaustive. Rather, these are examples of data that, to our knowledge, are processed by Google.

  • Referrer URL (the address of the page from which the visitor comes)
  • IP address (e.g., 256.123.123.1)
  • Information about the operating system (the software that enables your computer to operate. Well-known operating systems are Windows, Mac OS X, or Linux)
  • Cookies (small text files that store data in your browser)
  • Mouse and keyboard behavior (every action you perform with the mouse or keyboard is stored)
  • Date and language settings (which language or date you have preset on your PC is stored)
  • All Javascript objects (JavaScript is a programming language that allows websites to adapt to the user. JavaScript objects can collect all kinds of data under one name)
  • Screen resolution (indicates how many pixels the image display consists of)

It is undisputed that Google uses and analyzes this data even before you click the “I am not a robot” checkbox. In the Invisible reCAPTCHA version, even checking the box is omitted, and the entire detection process runs in the background. How much and exactly what data Google stores is not detailed by Google.

The following cookies are used by reCAPTCHA: We refer to the reCAPTCHA demo version from Google at https://www.google.com/recaptcha/api2/demo. All these cookies require a unique identifier for tracking purposes. Here is a list of cookies that Google reCAPTCHA has set on the demo version:

Name: IDE

Expiration: after one year

Usage: This cookie is set by DoubleClick (also owned by Google) to register and report a user’s actions on the website in connection with advertisements. This allows advertising effectiveness to be measured and appropriate optimization measures to be taken. IDE is stored in browsers under the doubleclick.net domain.

Example value: WqTUmlnmv_qXyi_DGNPLESKnRNrpgXoy1K-pAZtAkMbHI-211097883

Name: 1P_JAR

Expiration: after one month

Usage: This cookie collects statistics on website usage and measures conversions. A conversion occurs, for example, when a user becomes a buyer. The cookie is also used to display relevant advertisements to users. Furthermore, the cookie can prevent a user from seeing the same advertisement more than once.

Example value: 2019-5-14-12

Name: ANID

Expiration: after 9 months

Usage: We could not find much information about this cookie. In Google’s privacy policy, the cookie is mentioned in connection with “advertising cookies” such as “DSID,” “FLC,” “AID,” “TAID.” ANID is stored under the google.com domain.

Example value: U7j1v3dZa2110978830xgZFmiqWppRWKOr

Name: CONSENT

Expiration: after 19 years

Usage: The cookie stores the status of a user’s consent to the use of various Google services. CONSENT also serves security purposes, to verify users, prevent credential fraud, and protect user data from unauthorized attacks.

Example value: YES+AT.de+20150628-20-0

Name: NID

Expiration: after 6 months

Usage: NID is used by Google to tailor advertisements to your Google search. With the help of the cookie, Google “remembers” your most frequently entered search queries or your previous interaction with ads. This way, you always receive customized advertisements. The cookie contains a unique ID that Google uses to collect the user’s personal settings for advertising purposes.

Example value: 0WmuWqy211097883zILzqV_nmt3sDXwPeM5Q

Name: DV

Expiration: after 10 minutes

Usage: As soon as you check the “I am not a robot” box, this cookie is set. The cookie is used by Google Analytics for personalized advertising. DV collects information in anonymized form and is also used to distinguish users.

Example value: gEAABBCjJMXcI0dSAAAANbqc211097883

Note: This list cannot claim to be exhaustive, as Google’s choice of cookies changes repeatedly, based on experience.

How long and where is the data stored?

By embedding reCAPTCHA, your data is transferred to the Google server. Google does not clearly state exactly where this data is stored, even after repeated inquiries. Without confirmation from Google, it can be assumed that data such as mouse interaction, time spent on the website, or language settings are stored on European or American Google servers. The IP address that your browser transmits to Google is generally not merged with other Google data from other Google services. However, if you are logged into your Google account while using the reCAPTCHA plugin, the data will be merged. Google’s separate privacy policies apply to this.

How can I delete my data or prevent data storage?

If you do not want data about you and your behavior to be transmitted to Google, you must completely log out of Google and delete all Google cookies before visiting our website or using the reCAPTCHA software. As a rule, data is automatically transmitted to Google as soon as you access our site. To delete this data again, you must contact Google Support at https://support.google.com/?hl=de&tid=211097883.

Therefore, by using our website, you agree that Google LLC and its representatives automatically collect, process, and use data.

You can learn more about reCAPTCHA on Google’s web developer page at https://developers.google.com/recaptcha/. While Google goes into more detail about the technical development of reCAPTCHA here, precise information about data storage and privacy-relevant topics is also sought in vain there. A good overview of the general use of data at Google can be found in their own privacy policy at https://www.google.com/intl/de/policies/privacy/.
